Terms of Use

Welcome to ShiaFamily. These Terms of Use ("Terms") are a binding agreement between you and ShiaFamily ("we", "our", "the app"), a service operated from Canada and offered to a worldwide Shia Muslim audience. By creating an account or otherwise using ShiaFamily, you agree to these Terms. If you do not agree, do not use the app.
1. Who can use ShiaFamily
- You must be at least 18 years old to create or hold an account, including in Guardian (wali) mode.
- You must provide accurate, truthful information about yourself and, if applicable, the person you are creating a profile for as a guardian, with that person's knowledge and consent.
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- We may refuse service, suspend, or terminate any account at our sole discretion, including for suspected dishonesty, misconduct, or violation of these Terms.
2. The nature of the service
ShiaFamily is a platform that lets members create profiles and connect with other members for the purpose of Islamic marriage (nikah). ShiaFamily is a communication and discovery tool only. We do not perform background checks, verify identities, verify marital status, verify religious claims, or vouch for the character, intentions, or safety of any member. We do not officiate, arrange, broker, or guarantee any marriage, engagement, or relationship, and we make no representation that using the app will result in a match, marriage, or any particular outcome.
You are solely responsible for exercising your own judgment, and involving your family, guardian, and community as you see fit, before meeting, communicating with, or entering into any relationship or agreement with another member. We strongly encourage independent verification of anything another member tells you about themselves.
3. Your conduct
You agree not to, and confirm you will not, on or through ShiaFamily:
- Impersonate any person, or misrepresent your identity, age, marital status, or intentions.
- Harass, threaten, defraud, deceive, or financially solicit any other member.
- Post or send unlawful, obscene, hateful, or sexually explicit content.
- Use the app for any commercial solicitation, advertising, or unrelated recruiting.
- Attempt to circumvent, disable, or interfere with the app's security, moderation, or reporting features.
- Scrape, copy, or harvest other members' data or photos for any purpose outside the app.
- Use the app if you have been convicted of a felony, sexual offense, or violent crime.
Violating this section is grounds for immediate suspension or termination, and where relevant, a report to law enforcement.
4. Reporting and safety
We provide in-app blocking and reporting tools so members can flag suspicious behaviour, and we review reports we receive. We cannot monitor every interaction on the platform in real time, and we are not responsible for the conduct of any member, on or off the app. Meeting anyone you connect with through ShiaFamily — including in person — is entirely at your own risk and discretion. Always meet in a public place, inform a trusted third party, and involve your guardian or family as is appropriate for you.
ShiaFamily is not responsible for, and disclaims all liability for, any harassment, fraud, scam, financial solicitation, or emotional or psychological abuse by any member, whether it occurs through the app or in any offline interaction between members. We are a platform for connecting members, not a party to any relationship formed through it, and we cannot guarantee the honesty, intentions, or behaviour of anyone you meet on ShiaFamily. If you experience or witness any of the above, please use the in-app Block and Report tools immediately and, if you believe a crime has occurred, contact your local law enforcement. You may also email us at shiafamilycare@gmail.com to report a safety concern.
5. Content you submit
You retain ownership of the photos, bio, and other content you submit. By submitting content, you grant ShiaFamily a worldwide, non-exclusive, royalty-free license to host, store, and display that content to other members solely for the purpose of operating the app. You confirm you have the right to post everything you submit, and that it does not infringe anyone else's rights.
6. Donations
Donations made through the app are voluntary and processed by our third-party payment processor. Donations are non-refundable except as required by law or at our sole discretion.
7. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR TRUTHFULNESS OF ANY MEMBER'S PROFILE OR CONTENT, AND WE DO NOT WARRANT THAT ANY MEMBER IS WHO THEY CLAIM TO BE.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SHIAFAMILY, ITS OPERATORS, EMPLOYEES, VOLUNTEERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, YOUR INTERACTIONS WITH ANY OTHER MEMBER (ONLINE OR IN PERSON), OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE APP IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) CAD $50. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify, defend, and hold harmless ShiaFamily and its operators, employees, volunteers, and affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of or related to: your use of the app; your violation of these Terms; your interactions with any other member; or content you submit.
10. Dispute resolution and arbitration
Please read this section carefully — it limits how you can bring disputes against us.
- Informal resolution first. Before filing any claim, you agree to contact us at shiafamilycare@gmail.com and give us 30 days to resolve the dispute informally.
- Binding arbitration. If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the app will be resolved by final and binding arbitration on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court where permitted.
- Class action waiver. You agree that any arbitration or claim will be conducted only on an individual basis and not as a class, collective, or representative action, to the fullest extent permitted by law.
- Governing law and venue. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any arbitration or permitted court proceeding will take place in Ontario, Canada, unless another location is required by mandatory local law where you reside.
11. Termination
You may delete your account at any time from Settings. We may suspend or terminate your access at any time, with or without notice, for any reason, including a violation of these Terms. Sections 2, 3, 5, 7, 8, 9, 10, and 12 survive termination of your account or these Terms.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the app after a change takes effect constitutes acceptance of the updated Terms. Material changes will be reflected by updating the "Last updated" date above.
